Enforcing the ‘Community Interest’ in Combating Transnational Crimes: The Potential for Public Interest Litigation

Abstract Transnational criminal law treaties could give rise to public interest litigation concerning the breach of an obligation erga omnes partes , meaning owed by one state party all other states parties. This article aims contribute scholarship on subject or ‘community interest’ norms exploring potential for international non-compliance with obligations under two transnational in particular: United Nations Convention against Organized Crime and Corruption. have been overlooked existing literature community norms, even though parties a common ensuring compliance assumed these instruments, potential, at least theory, litigation. International courts tribunals, as well scholars, can ought engage deeper analyses what constitutes multilateral treaty.
